General Terms of Sale
These General Terms of Sale govern the relationship between Benzro and users purchasing products on our website. By placing an order, you agree to these terms, which apply to all transactions unless otherwise stated. The terms are accessible on our website at any time and supersede any conflicting documents or prior versions.
1. Definitions and Scope
- Parties: Benzro and the user are collectively referred to as the “Parties” and individually as a “Party.” Once an order is validated, the user becomes the “Buyer.”
- Eligibility: Users must be of legal age in their country of residence and have full legal capacity or parental/guardian authorization to make purchases.
- Acceptance: Placing an order on the Benzro website implies full acceptance of these General Terms of Sale, without requiring a physical signature. Validation of an order by clicking the “Buy” button serves as an electronic signature, equivalent to a handwritten signature, confirming the order and payment obligations.
- Scope: These terms apply exclusively to online sales of products offered by Benzro to non-professional buyers. The applicable terms are those in effect on the date of order validation. Buyers are responsible for saving or printing these terms for their records.
2. Products and Pricing
2.1 Pricing Product prices include any applicable discounts and VAT as of the order date. Prices are guaranteed based on stock availability, except in cases of significant changes in charges (e.g., VAT adjustments) or typographical errors. Shipping costs are additional and will be specified during order validation. Benzro reserves the right to modify prices at any time, but orders will be billed at the price displayed when the order is placed, subject to product availability. If an order contains errors (e.g., incorrect price, description, or photo), Benzro may cancel and refund the order.
2.2 Reference Price (“Crossed Out”) The “crossed out” price shown for comparison is an estimate provided by Benzro suppliers, reflecting the average retail price of the product in their traditional sales network on the date of sale. This price is indicative and for reference only.
3. Order Process
3.1 Website Navigation Users can freely browse the Benzro website to explore products without obligation to place an order.
3.2 Account Registration To place an order, users must register an account by completing the “My Account” section with accurate details, including full name, postal address, email address, phone number, and a secure password. Benzro ensures the confidentiality of data provided after password entry. Users are responsible for safeguarding their password and must promptly contact Benzro at support@benzro.com if it is lost to receive a new one. A “Forgot Password” option is available on the homepage to reset passwords via email. Users may opt in to receive promotional emails or updates from Benzro during registration.
3.3 Placing an Order Orders are placed via the Benzro website. Users select products by clicking “Add to Cart” and can:
- View selected items by clicking “My Basket.”
- Continue shopping by selecting “Continue Shopping.”
- Proceed to checkout by clicking “Buy.”
Users must log in with their email and password or register if they don’t have an account. Orders cannot be placed from countries not listed in Benzro’s authorized delivery destinations. Before finalizing, users must verify the delivery address and review the order summary, which includes product details, quantities, prices, shipping costs, and total amount.
3.4 Order Validation To confirm an order, users click “Pay for the Order” after verifying all details. For payments via debit or credit card, users must provide:
- Cardholder’s name
- Card number
- Expiry date
- CVV code (last three digits on the card’s back)
Payments are processed securely through an Electronic Payment Terminal (EPT) system with SSL encryption, ensuring bank details are transmitted directly to the bank without being stored by Benzro. Once payment is confirmed, the order is final and irrevocable, recorded in Benzro’s secure system as proof of the transaction.
3.5 Order Confirmation After payment, Benzro sends an email confirmation to the provided email address, summarizing the order details and providing an estimated dispatch date. Buyers are encouraged to save or print this confirmation. Order details are also available in the buyer’s account. Benzro’s records serve as legal proof of all transactions.
4. Delivery and Availability
4.1 Product Availability and Dispatch
- Shipping Costs: Calculated during checkout based on delivery address, product weight, and volume. Costs are displayed before payment and may vary due to negotiated rates with transport partners.
- Dispatch Times: Most products are in stock for dispatch within 48 hours (2 business days), as indicated on product pages. For out-of-stock items, dispatch times are estimates and may be delayed due to factors like weather, supplier delays, or holidays. Buyers should verify dispatch times before confirming orders.
- Delivery Areas: Benzro ships to the European Union, the United Kingdom, Ireland, and select neighboring countries (restrictions may apply for non-continental territories).
4.2 Delivery Process
- Delivery is at street level and does not include home pickup or assembly. Buyers must be present for delivery.
- Upon receipt, buyers must inspect the package for visible damage (e.g., torn wrapping, wet or open boxes). Any issues must be noted on the Proof of Delivery (POD) document before signing. Phrases like “subject to unpacking” are not legally valid.
- If the package appears compromised, buyers may refuse delivery. Disputes must be reported to support@benzro.com within 24 hours of receipt, with photos of the damage. Failure to report within this timeframe or to retain packaging may result in claim rejection.
- If a delivery attempt fails due to an incorrect address or absence, a second attempt will incur additional charges payable by the buyer.
- For certain territories, orders may be invoiced without VAT, and buyers are responsible for customs clearance and applicable taxes. Failure to pay these may result in the product being returned, with the buyer covering return and reshipping costs.
4.3 Non-Compliant Goods Upon collection or delivery, buyers must verify the condition and compliance of products. If an item is damaged, missing, or non-compliant, notify Benzro Customer Service within 24 hours at support@benzro.com. Include detailed observations and photos. If the transport provider does not allow inspection, note this on the POD (e.g., “Provider refused to wait for inspection”). Claims after 24 hours or without proper documentation will be rejected. If a package cannot be collected, Benzro will store it and may charge for a second delivery attempt.
5. Right of Withdrawal and Returns
5.1 Right of Withdrawal Buyers have 14 calendar days from receipt of their order to notify Benzro of their intent to return non-customized products. To initiate a return, log into “My Account,” select the order, and click “Record a Return” to obtain a return number. An additional 8 working days are provided to return the item at the buyer’s expense. Products must be unused, in their original condition, and in original (or suitable) packaging. This right does not apply to made-to-order or personalized items.
5.2 Return Process Returns can be arranged independently to Benzro, Flat 3, 232 Alcester Road – Brimingham England CV37 9LG United Kingdom, using a trackable service, or Benzro can organize the return (items must be accessible at street level). Buyers must retain proof of return, including the recipient’s address, dispatch date, and tracking number. Return shipping costs are the buyer’s responsibility, except for defective or incorrect items, where Benzro covers the cost.
5.3 Refunds Refunds are processed within 14 working days of Benzro receiving the returned goods, provided they meet the return conditions. The refund amount excludes shipping costs. If the entire order is returned, the full product cost (excluding shipping) is refunded.
5.4 Cancellation Policy
- Stock or In-Transit Items: Orders for in-stock or in-transit items can be canceled within the first calendar week after payment, with an 80% refund (20% covers administrative costs). Cancellations after one week but before dispatch are eligible for a 60% refund. Requests must be submitted via “My Account” under “Cancellation Request.” Refunds are processed within 30 working days.
- Made-to-Order Items: Items with 12–18 week dispatch times cannot be canceled, even if delayed.
- Post-Dispatch Cancellations: If delivery is refused or canceled after dispatch, buyers are responsible for delivery and return shipping costs, deducted from any refund.
6. Payment
6.1 Total Amount The total order amount, including products, shipping, and applicable taxes, is displayed before confirmation and in the emailed order summary.
6.2 Payment Methods Payments are accepted via Visa, Eurocard/MasterCard, bank wire transfer, or PayPal. PayPal users must update delivery addresses through PayPal, not via customer support.
6.3 Payment Confirmation Orders are valid only after payment confirmation. Benzro reserves the right to cancel orders due to payment issues, prior disputes, or bank rejections. Payments via debit card are processed within 2–5 days, depending on the bank.
6.4 Fraud Prevention To prevent fraudulent use of payment details, Benzro may request a valid ID and proof of residence (dated within three months) for orders above a certain threshold. Orders will not be processed until these documents are verified. Failure to provide them may result in a refund.
7. Coupons and Vouchers
7.1 Coupons Discount coupons are applied using a code entered during checkout or pre-assigned to a user’s account. Coupons are sent via email or awarded during promotions, have an expiry date, and cannot be converted to cash. Multiple coupons may be used per order unless specified otherwise. The basket value (excluding shipping) must exceed the coupon value or meet any minimum purchase requirements. Coupons cannot be applied retroactively to completed orders.
7.2 Using Coupons Enter the coupon code in the “Summary” window during checkout and click “OK” to apply the discount. The deduction is reflected before shipping costs are added.
7.3 Refunds with Coupons If a coupon is used, the discount is proportionally distributed across all items. Refunds account for this proportional discount.
7.4 Vouchers Vouchers, issued as a goodwill gesture, act as store credit and are valid for three months with no restrictions. Apply them during checkout by selecting the “Credit” option. Vouchers are non-refundable.
8. Data Protection
8.1 Personal Information To process orders, Benzro collects your full name, email address, postal address, and phone number. In accordance with the GDPR (April 27, 2016), we use this data to:
- Fulfill orders and provide customer support.
- Send marketing communications with your consent (which you can revoke).
- Comply with legal obligations (e.g., tax laws).
- Pursue legitimate interests, such as improving services, unless overridden by your rights.
We share data only with trusted service providers (e.g., shipping companies) or for legal compliance. Data is retained for up to 4 years or as required by law. Information may be processed outside the EU (e.g., in the US) through secure third-party hosting services. EU residents have rights to access, modify, restrict, delete, or object to data processing, and to file complaints with local data protection authorities. 8.2 Cookies and Web Beacons Benzro uses session cookies, deleted upon logout, to enhance your browsing experience. Web beacons may be used by partners to track page visits anonymously for statistical purposes, ensuring no personal data is collected.
9. Guarantees and Responsibilities
9.1 Product Information Benzro provides detailed product descriptions based on supplier information. While we strive for accuracy, errors may occur, and images/colors may vary due to browser or screen settings. Buyers can contact support@benzro.com to report discrepancies, and we’ll correct them promptly. Some products, like vintage-style items, may have intentional wear (e.g., fading, creases), which is not a defect. Leather products use genuine leather for visible components, but non-visible areas may use other materials.
9.2 Guarantees Product warranties are detailed in the product description. If an item is defective within the warranty period, contact support@benzro.com immediately for repair, replacement, or refund options. Benzro will provide supplier contact details for after-sales support if needed.
9.3 Responsibilities Benzro’s liability is limited to the order amount. We are not responsible for damages caused by internet use, service interruptions, or misuse of products. Buyers must verify local import regulations, as Benzro is not liable for non-compliance with destination country laws.
10. Force Majeure
Benzro is not liable for failure to fulfill obligations due to force majeure events (e.g., strikes, floods, or natural disasters). Both parties will communicate to resolve issues. If delivery is impossible after two months due to force majeure, Benzro will refund the full order amount.
11. Intellectual Property
All website content, including visuals, audio, and technology, is protected by copyright, trademarks, or licenses and is the exclusive property of Benzro. Linking to our homepage requires prior permission. Unauthorized framing or in-line linking is prohibited. Benzro is not responsible for content on linked third-party websites.
12. Partial Invalidity
If any clause is deemed invalid due to legal changes or judicial decisions, the remaining terms remain enforceable.
13. Entire Agreement
These General Terms of Sale and the order confirmation form the complete contractual agreement between Benzro and the Buyer.
14. Applicable Law and Jurisdiction
These terms are governed by the laws of the United Kingdom. Any disputes will be resolved in competent UK courts under common law principles.
